We have one of the largest energy law practices in the State of Hawaii. Our clients include developers of wind, solar, hydro, biomass, and biofuel projects, as well as one of the two petroleum refineries in Hawaii. Additionally, we represent various EPC companies. We assist our clients in a wide range of areas, including acquisition, financing, permitting and entitlements, federal, state and local regulatory matters, EPC contracts, and power purchase and other off take agreements. We have extensive experience negotiating with all of Hawaii’s electric utilities. We regularly appear before the Hawaii Public Utilities Commission on energy and other matters, and we regularly work with the Division of Consumer Advocacy of the Hawaii Department of Commerce and Consumer Affairs, and the Strategic Industries Division of the Hawaii Department of Business, Economic Development and Tourism. We are involved, on behalf of various clients, in numerous energy policy forums and proceedings. We also assisted in the drafting of recently-enacted legislation relating to energy matters, including legislation establishing streamlined permitting and entitlement processes for utility-scale renewable energy projects.

We represent owners, lenders, developers, lessors and lessees of commercial, industrial, resort and residential real estate in Hawaii. Such work includes drafting and negotiating acquisition, financing, leasing, and development (subdivisions, condominiums and planned developments) documentation, along with procuring land use and other governmental approvals and permits.

We represent several of Hawaii’s largest institutional landowners, including the Queen Emma Land Company (fka The Queen Emma Foundation), Castle & Cooke, Inc. and Alexander & Baldwin, Inc., in connection with a wide range of real estate activities, including acquisitions, sales and leasing.

We represent several national lenders in connection with their commercial and community lending activities in Hawaii. We have extensive experience in drafting and negotiating loan documents and in coordinating the closing of complex financing transactions for real estate developments, construction loans, term loans and other secured transactions.

We also have significant experience in the finance and development of affordable housing and government-sponsored projects, including projects involving federal and state low-income housing tax credits (representation of lenders and developers), Hawaiian Home Lands (representation of lenders and developers), and Hawaii Housing Finance and Development Corporation (representation of developers).

We have a broad range of experience in public utilities, telecommunications and energy law. Our attorneys have represented a broad range of utilities and service providers, including telecommunications providers, independent power providers, renewable energy project developers, and water and sewer service providers. Our attorneys represent or have represented many telecommunications companies and entrepreneurs, including competitive local exchange carriers, cellular, PCS, EMSR and LMDS wireless licensees, and eligible telecommunications carriers. Our work for such clients include seeking FCC licenses for wireless spectrum, public utilities and other regulatory matters, infrastructure development, leasing and licensing of antenna sites, and land use and zoning matters. Our attorneys have served as Hawaii counsel in connection with the merger of Charter Communications with Time Warner Cable and Bright House Networks and the development of the Hawaii networks for three international wireless carriers, VoiceStream Wireless (now T-Mobile), Nextel Communications/Nextel Partners (now Sprint Nextel) and Clear, LLC. We are also Hawaii counsel for one of the largest telecommunications providers in the world, CenturyLink.
